There are two potential problems: first, the driver is illegally driving without car insurance. Second, the driver only carries a minimum insurance coverage and your losses or car damages exceed that amount.

Most car insurance policies include Uninsured Motorist/Underinsured Motorist (UM/UIM) coverage. If the other uninsured driver was the one who caused the accident, your own insurance policy will pay for your personal injuries, if you have “uninsured motorist” or medical payments” coverage. If the other driver’s auto insurance coverage is not enough to pay for all of your damages, your own insurance may pay the difference, if you have “underinsured motorist” coverage. If you do not have these kinds of car insurance or if your damages are more than the policy’s limit, you can sue the other driver’s negligence. If the other driver’s negligence was the cause of the accident, occupants in your car are covered for medical expenses and lost wages for a minimum of $20,000 per individual/$40,000 per accident. Thus, it will be best for drivers to purchase more than the minimum coverage. Also, it may be necessary to take your insurance company to court if they are not willing to cover the claim.

In Colorado, based on auto insurance laws, a statewide database has been established to track compliance and noncompliance within Colorado, of motor vehicle insurance requirements. On a monthly basis, car insurance companies are mandated to submit information on policies issued during the previous month. This information is also submitted to the database by vehicle registration offices on vehicles registered.

The database includes information about your Colorado driver’s license, vehicle, and any information submitted by insurance companies regarding insured vehicles and all individuals listed as insured on your policy. Information submitted by car insurance companies includes: the Vehicle Identification Number (VIN), make and year of the vehicle, and the name, date of birth, driver’s license number, and address of each individual insured or owner on the policy. This information allows for a match to the Colorado State vehicle and driver files. If in case you have been stopped by a police officer and you do not have evidence of insurance in your car or you are not listed in the database as having insurance, your driver’s license is subject to confiscation and suspension. Per CRS 42-2-127.7 you may request for a hearing or present proof of insurance that was valid at the time you were stopped, at a driver’s license office or at 1881 Pierce Street in Lakewood, Colorado.

Gap insurance is a type of car insurance coverage that pays the difference between your insurance settlement (from a covered loss) and your loan balance. If your primary insurance company is not paying out a settlement for a covered loss such as the vehicle being declared a total loss because of an accident then your GAP insurance will not pay out either.

If you are upside down on your car and want to trade it in, your gap insurance coverage would not be able to be used in this situation.

The SR-22 insurance which is attached to her insurance is not a type of insurance but a form or certificate that the state is requiring him to have filed to prove that she is carrying the insurance on her that the state required. Typically this insurance is the state’s required liability car insurance.

Your employee can check from her insurance broker or agent to verify if her personal insurance policy would cover the company car but keep in mind that the company’s high risk insurance policy in Chicago will be primary and needs to stay on the company vehicle so that it will be properly covered.

Once you have been convicted of the speeding violation, the state of WI courts will likely send the information about this speeding citation back to Illinois. According to Administrative Code information out of state traffic violations will be added to your IL driving record and assigned points.

As for your insurance cost, if the WI speeding violation is put on your  Illinois driving record then your insurance provider, could see it the next time they pull your Motor Vehicle Record. Depending upon their rating system this out of state traffic ticket may or may not increase your car insurance premium cost.
